Free Tools Terms

1. Applicability

1.1 These Free Tools Terms govern access to and use of ClearSKY's free browser-based tools, including polygon.clearsky.vision, tiles.clearsky.vision, and related polygon, AOI, tile, conversion, validation, viewing, and utility tools that ClearSKY makes available without a paid service commitment (the "Free Tools").

1.2 The Free Tools are intended for business, professional, technical, or evaluation use. They are not paid production services and are not covered by ClearSKY's paid-service commitments unless ClearSKY expressly says otherwise in writing.

1.3 These Free Tools Terms do not govern ClearSKY's paid subscription services, account-based dashboard services, APIs, data deliveries, or beta services offered to B2B customers. Those services are governed by the applicable commercial agreement, the Master Terms of Service, any applicable Data Service Terms, and any applicable Beta Services Addendum.

2. Acceptance

2.1 By accessing or using a Free Tool, you agree to these Free Tools Terms, the Privacy Policy, and the Acceptable Use Policy.

2.2 If you use a Free Tool on behalf of an organisation, you confirm that you have authority to use the Free Tool for that organisation and to provide any content submitted through the Free Tool.

3. Local Processing and Optional Cloud Features

3.1 Many Free Tool features run locally in your browser. For those features, ClearSKY may not receive the files, geometries, coordinates, or other content you process locally.

3.2 Some optional features may require or allow server-side processing, sign-in, saving, syncing, sharing, sending content to the ClearSKY Dashboard, loading remote data, or using third-party services. If you use those features, ClearSKY may process the content and technical data needed to provide the feature.

3.3 You are responsible for checking which feature you are using and for deciding whether the content is suitable for that feature.

4. No SLA, Support Commitment, or Storage Commitment

4.1 The Free Tools are provided free of charge on an "as is" and "as available" basis.

4.2 The Free Tools are not covered by any SLA, uptime guarantee, support response commitment, timeliness commitment, service credit, reprocessing remedy, or long-term storage commitment unless ClearSKY expressly says otherwise in writing.

4.3 Export and keep your own copies of anything important. Free Tools are not backup, archive, compliance, or sole-copy storage services.

5. Your Content

5.1 As between you and ClearSKY, you retain ownership of files, geometries, AOIs, coordinates, metadata, exports, and other content you submit to or create with a Free Tool ("User Content").

5.2 If a Free Tool uses optional server-side or account-linked features, you grant ClearSKY a non-exclusive, worldwide, royalty-free right to host, copy, process, transmit, display, store, and otherwise use User Content only as needed to provide the requested feature, secure and operate the Free Tool, prevent abuse, troubleshoot issues, and comply with law.

5.3 You must have the rights and permissions needed to upload, process, convert, view, share, or export User Content through the Free Tools.

6. Validate Outputs Yourself

6.1 You are responsible for checking geometries, conversions, projections, areas, tile views, exports, and other outputs before relying on them.

6.2 Do not rely on Free Tool outputs as the sole basis for legal, cadastral, surveying, regulatory, safety-critical, compliance, financial, or operational decisions.

7. Third-Party Services and Content

7.1 Free Tools may include or rely on third-party basemaps, overlays, tiles, APIs, hosting, authentication, analytics, storage, or other services.

7.2 Third-party services may be subject to separate terms, attribution requirements, technical limits, pricing, privacy notices, or availability constraints. You are responsible for complying with those requirements where they apply to your use.

8. Acceptable Use

8.1 You must comply with the Acceptable Use Policy. You must not misuse the Free Tools, interfere with their operation, bypass limits or access controls, overload or scrape the tools, upload content you do not have the right to use, or use the Free Tools in breach of applicable law.

8.2 ClearSKY may suspend, throttle, restrict, or block access to the Free Tools where ClearSKY reasonably believes this is needed to protect security, integrity, availability, legal compliance, third parties, or other users.

9. Changes and Retirement

9.1 ClearSKY may add, change, restrict, suspend, or discontinue any Free Tool or feature at any time.

9.2 ClearSKY may update these Free Tools Terms from time to time. The updated terms apply from the stated effective date or, if no date is stated, when posted.

10. Disclaimers

10.1 To the maximum extent permitted by law, the Free Tools are provided without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, compatibility, or uninterrupted operation.

10.2 ClearSKY does not warrant that the Free Tools, outputs, third-party services, or User Content storage will be accurate, complete, secure, available, error-free, retained, or suitable for any particular workflow.

11. Liability

11.1 To the maximum extent permitted by law, ClearSKY will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, business, data, User Content, or business interruption, arising out of or relating to the Free Tools.

11.2 To the maximum extent permitted by law, ClearSKY's aggregate liability arising out of or relating to the Free Tools will not exceed EUR 50 in total.

11.3 Nothing in these Free Tools Terms excludes or limits liability that cannot lawfully be excluded or limited.

12. Governing Law

12.1 These Free Tools Terms and any non-contractual disputes arising out of or in connection with them are governed by the laws of Denmark, excluding conflict-of-laws rules.

12.2 The courts of Denmark have exclusive jurisdiction over disputes arising out of or in connection with these Free Tools Terms, unless otherwise required by law.
