Acceptable Use Policy

1. Applicability

1.1 This Acceptable Use Policy (the "AUP") applies to all access to and use of ClearSKY’s services, APIs, data products, websites, dashboards, tools, previews, trials, beta services, free services, and related offerings (collectively, the "Services").

1.2 This AUP supplements the applicable agreement governing the relevant Services, including the Master Terms of Service, the Data Service Terms, and the Free, Trial and Beta Terms.

1.3 Violations of this AUP may result in suspension, throttling, blocking, cancellation of requests, termination of access, removal of content, legal action, or any other remedy available to ClearSKY.

2. General Compliance Requirements

You must use the Services only in compliance with applicable law, the applicable agreement, the Documentation, and this AUP.

You are responsible for your own conduct, your Authorized Users, your contractors, your integrations, and any activity occurring through your accounts, credentials, API keys, tokens, or access mechanisms.

3. Prohibited Illegal, Infringing, and Harmful Use

You must not use the Services:

  • for any unlawful, fraudulent, deceptive, or misleading purpose;
  • to violate intellectual property rights, privacy rights, confidentiality obligations, publicity rights, trade secret rights, or other third-party rights;
  • to submit, process, store, publish, or distribute content that you do not have the right to use;
  • in connection with stalking, harassment, unlawful surveillance, discrimination, threats, or abuse;
  • to facilitate sanctions violations, export-control violations, or trade-restriction violations; or
  • in any way that would cause ClearSKY or its providers to violate applicable law or third-party obligations.

4. Prohibited Security Abuse and Service Interference

You must not:

  • interfere with, disrupt, degrade, damage, disable, or overload the Services or the infrastructure supporting them;
  • attempt to gain unauthorized access to accounts, systems, networks, data, credentials, tokens, APIs, or environments;
  • probe, scan, test, or attempt to discover vulnerabilities, bypass security measures, or evade access controls without ClearSKY’s prior written authorization;
  • introduce malware, malicious code, harmful payloads, denial-of-service traffic, or abusive automation;
  • use the Services in a way that materially consumes disproportionate resources or bypasses reasonable rate limits, concurrency limits, quotas, storage limits, or similar controls; or
  • use any robot, crawler, scraper, or automated system to access the Services in a manner not expressly permitted by the Documentation or by ClearSKY in writing.

5. Prohibited Account and Credential Misuse

You must not:

  • share credentials except as expressly permitted by the agreement;
  • sell, rent, lease, transfer, or provide access to accounts, API keys, tokens, or credentials to unauthorized third parties;
  • impersonate another person or entity, or misrepresent your identity, affiliation, authority, or entitlement to use the Services;
  • create fake accounts, evade account restrictions, or re-register to avoid prior enforcement actions; or
  • fail to take reasonable steps to protect credentials, tokens, and access mechanisms under your control.

6. Prohibited Reverse Engineering, Extraction, and Competitive Misuse

Except to the extent expressly permitted by mandatory law or by a signed written agreement, you must not:

  • reverse engineer, decompile, disassemble, translate, reconstruct, or otherwise attempt to derive the source code, models, methods, workflows, or underlying structure of the Services;
  • attempt model extraction, parameter extraction, prompt extraction, workflow extraction, or similar reconstruction of ClearSKY’s technology;
  • scrape, bulk extract, mirror, or reconstruct a materially similar dataset, service, model input layer, or output archive from the Services;
  • use the Services or outputs to create, train, validate, benchmark, improve, or power a competing or substitute service, API, model, or dataset offering;
  • operate a pass-through, proxy, reseller, OEM, or white-label service using the Services or outputs except where expressly permitted in writing; or
  • publish benchmarking or comparative testing results relating to the Services without ClearSKY’s prior written consent.

7. Prohibited Misuse of Data, Outputs, and Attributions

You must not:

  • remove, obscure, alter, or falsify source notices, proprietary notices, attribution notices, metadata, or legal notices required by ClearSKY or applicable third-party terms;
  • use outputs or Delivered Data beyond the scope of the license granted under the applicable agreement;
  • redistribute raw outputs, raw Delivered Data, or substantially similar outputs in violation of the applicable agreement;
  • present outputs in a misleading way, including by implying accuracy, certification, or endorsement beyond what the applicable agreement permits; or
  • use third-party basemaps, overlays, source data, or integrated third-party content in breach of their applicable terms or attribution requirements.

8. Restricted High-Risk and Sensitive Use

Unless ClearSKY has expressly agreed otherwise in writing, you must not use the Services as the sole or primary basis for decisions in contexts where material harm could result from errors, delays, omissions, or inaccurate outputs, including:

  • emergency response or life-safety decisions;
  • military targeting or weapons-related applications;
  • nuclear, missile, chemical, or biological weapons activities;
  • legally binding cadastral, boundary, surveying, or regulatory determinations without independent verification;
  • automated decisions with significant legal or similarly material effects where independent review is required by law or good practice; or
  • other high-risk use cases where independent validation is reasonably required.

For clarity, this Section does not grant any permission for uses that are otherwise prohibited by law or by the applicable agreement.

9. Compliance with Documentation and Technical Rules

You must comply with the then-current Documentation and any reasonable technical, operational, and security requirements communicated by ClearSKY, including requirements relating to:

  • supported request formats and payloads;
  • AOI, geometry, tile, coordinate, or ordering rules;
  • supported integrations and delivery mechanisms;
  • rate limits, concurrency limits, quotas, and storage limits;
  • credential handling and authentication requirements; and
  • incident response, abuse prevention, or security controls.

10. Monitoring, Enforcement, and Cooperation

10.1 ClearSKY may monitor use of the Services, including through logs, telemetry, abuse-detection tools, and manual review, to enforce this AUP, protect the Services, prevent fraud and abuse, maintain security, support customers, and comply with law.

10.2 If ClearSKY reasonably believes that you have violated this AUP or that your use creates security, legal, operational, or abuse risk, ClearSKY may, with or without notice:

  • throttle, block, filter, or rate-limit requests;
  • reject, quarantine, or cancel requests or jobs;
  • suspend or restrict access to some or all Services;
  • disable or rotate credentials or tokens;
  • remove or restrict access to content or stored items;
  • require remediation steps before restoring access; or
  • terminate access where permitted by the applicable agreement.

10.3 ClearSKY may investigate suspected violations and may cooperate with law enforcement, regulators, rights holders, infrastructure providers, and affected third parties where reasonably necessary or legally required.

10.4 ClearSKY has no liability for good-faith enforcement actions taken under this AUP.

11. Reporting Suspected Abuse

Suspected violations of this AUP may be reported to [email protected].

12. Changes to this Policy

12.1 ClearSKY may update this AUP from time to time.

12.2 Updates to this AUP take effect in accordance with the terms of the agreement governing the relevant Services.
